Feldman and DeMuth Jailed for Contempt; DeMuth Now Charged Under AETA

The federal government's Green Scare campaign took another depressing turn Tuesday morning as a federal district judge in Iowa ordered the detainment of Twin Cities activists Scott DeMuth and Carrie Feldman at a contempt hearing. As previously reported, DeMuth and Feldman were subpoenaed to a grand jury in Davenport, Iowa, compelling them to testify regarding a animal rights-related vandalism incident at the University of Iowa.

Feldman and Scott spoke to the local press and 30 to 40 supporters at a rally beforehand in Davenport, then refused to testify. At the contempt hearing, the judge offered both immunity, but they still refused to talk, and were taken away. The judge believes they will remain in jail until they comply or the jury ends (likely in 11 months).

BREAKING 11:00am Thursday: Quad City Times reports DeMuth has been charged with conspiracy under the Animal Enterprise Terrorism Act (AETA).

According to the Times, DeMuth made his initial appearance on the charge this morning.  The Times article quotes the indictment, which it says did not specify the 2004 ALF action at the University of Iowa, although the time frame and county location match:

“Scott Ryan DeMuth did knowingly and intentionally conspire with persons unknown to the grand jury to commit animal enterprise terrorism and cause economic damage to the animal enterprise in an amount exceeding $10,000."

Hoping to avoid detainment without any semblance of due process, Feldman's father testified at the contempt hearing that Feldman needs to not be incarcerated to care for her grandmother; DeMuth is studying as a PhD candidate. Since the federal prosecutor couldn't get Feldman to answer any questions, they used the opportunity to ask Feldman's father a bunch of odd leading questions. He was asked if Feldman was an anarchist, to which Feldman's public defender objected. The judge overruled the objection. The prosecutor presented a photo showing Feldman wearing something with an obscured "LF" on it and asked if it could mean "ALF" or "ELF." Also the prosecutor insinuated that a pet rat on her shoulder implied she was an animal lover or something — and thus, apparently, complicit in the vandalism?

With DeMuth and Feldman refusing to talk even when the judge granted immunity, it seemed there would be no way for them not to get held in contempt after they indicated through the legal team they would still not comply with the proceedings. About six supporters were in the courtroom. A supporter said it was "cool to see" they were "really solid and unwavering," but the judge found more than substantial reasons to incarcerate them. Their destination jail is being determined now.

Additionally, the authorities' writeup about Feldman's first appearance in Davenport, in October, which was before she was offered immunity, indicated the contempt in which prosecutors hold the Constitution: it says that Feldman invoked her Fifth Amendment "privilege" rather than terming it a "right," much as federal prosecutors have the right to prosecute, for example, billions of dollars in bank fraud but get the privilege of launching fishing expeditions over vandalism cases involving relatively tiny sums of money.

Between the quirks of the language authorities use and the leading questions, the conceptual framework that lets the feds ignore much greater criminal problems in society was in evidence. Supporters rallying at the Minneapolis Federal Courthouse this morning bumped into a retired member of the clergy wearing an orange jumpsuit, carrying a sign about waiting for justice to be served against those who ordered torture from the top of the government. She was a member of the WAMM "Tackle Torture at the Top" project, which locally demonstrated against Condoleezza Rice recently

Wasn't Scott's subpoena just for his fingerprints, though?  Once he gets booked for contempt, and the state fingerprints him, doesn't that 'fulfill' his supposed obligations to the fishing expedition?  I like to think there's hope that he, at least, could be free fairly soon.

How the hell do you get 'immunity' for providing fingerprints, though?  Or did the judge just not have a clue about what was going on?

He was subpoenaed twice; once for his fingerprints and once for his testimony. He is refusing to provide testimony.

Holy crap, I didn't think that they would just lock them up.  WTF  I didn't think that grand juries meant much, at least that's what I have understood from what people have been saying on here.  Dang, they're fucked, huh.

No, WTF, they are not fucked.  They are principled and strong and an anedote to the kind of infection that was given to the movement by Brandon Darby, Panda, Anna, Jake the Snake and others who shattered dreams and hearts and strong circles with the deepest of betrayals.  No their stand is a message that the next generation has got what it takes to create a real movement of social transformation.  It also tells the FBI and others to stay the fuck out of T-Town, cause you will meet a wall of silence and the kind of dedication that will scare you.  You don't get it do you, why young people would give up their freedom for us all.  I love you guys, damnit.  Don't you ever forget what you have done to give old farts like me hope who had been crushed by this whole green scare.  Together we are stong, carrie and scott, we will never forget what you have done.

By the way   Quad City Times did an editorial but they spelled 'moxie' wrong -- kind of BS but not wholly negative "We hope young animal rights activists Carrie Feldman and Scott DeMuth don’t stay in jail too long. We kind of admire their gumption, even if their ethics and tactics seem a bit screwy."

How would he be charged under AETA? AETA did not pass until 2006.  Wouldn't the alleged conspiracy, which happened in 2004, fall under the earlier version of the law, the Animal Enterprise Protection Act?  AEPA carried a one year maximum sentence for economic damage over 10,000 dollars. 

damn good question.  the AEPA and AETA both had/have the same section of US code (18 USC 43), which is the one Scott's charged under.  Unless there's some sort of retroactive provision, maybe AEPA ought to apply? Hm...

The AEPA was also amended, so the version of the statute active in 2004 would possibly carry a 3 year maximum sentence for the economic damage of what's alleged. 

Also of note is that the indictment was handed down ONE DAY before the statute of limitations expired.  Alleged Co-conspirators are "unknown to the grand jury." And the weak "evidence" against him appears to be a journal and lock-picking devices, according  to mainstream media reports of his arraignment:

Wow, it appears that this indictment is completely bogus.  They have a private journal and simple lock picking materials?  This was clearly brought to scare DeMuth into giving information they may believe he has, probably hunches they developed through the illegal wiretaps and surveillance conducted during the RNC investigations.  The smart thing for Scott is to stay strong and stay silent.  Let's all support him in this process!

The Daily Planet article said, "They had been given total use immunity, which means they could not face criminal charges based on the answers they gave, with the exception of charges for pergury if they lied under oath."  It seems that they are looking for something or someone other than Carrie and Scott, and they didn't give them the information that they need and were fishing for.  Why would they give Scott total use immunity one day and 2 days later charge him and imply that he is one of the main suspects?  Would they really offer someone total use immunity if they think he committed the crime, especially a crime like this that they haven't been able to solve?  Waiting to finally charge him the day before the statute of limitations on the case expired also seems like a desperate move.  If they have had this evidence since the RNC, and it really amounted to anything, wouldn't they have charged him over a year ago?  Why did they suddenly change their minds?  Prosecutors and investigators need to quit playing with the lives of American citizens and with all people's lives!  What they forget is that this also affects the lives of people's family, friends, and everyone else.  We all need to get the word out and support Scott and Carrie.
